Terms and Conditions for IQOS Plus
Effective date: 28 January 2025
1. TERMS
1.1 Philip Morris (New Zealand) Limited, 46 Sale Street, Auckland Central, Auckland 1010 (‘Philip Morris’, ‘we’, ‘our’, ‘us’).
1.2 IQOS Plus Member means an existing, or new, IQOS customer who has an IQOS Account or has established or has opened an IQOS account inclusive of hard age verification as a current 18+ user of notifiable products (vaping products or smokeless tobacco products) and means ‘Account Holder’, ‘you’, ‘your’.
1.3 Philip Morris reserves the right to terminate or amend IQOS Plus without notice at any time noting IOQS Plus will be reviewed by 1 June 2025 and thereafter periodically.
1.4 No modification of these Terms is permitted by you, unless we expressly agree in writing.
2. Free Membership
2.1 No purchase is necessary to obtain or enrol in IQOS Plus as this is automatic upon account creation detailed in 1.2. Membership remains at the sole discretion of Philip Morris.
3. Tiers
3.1 IQOS Plus: All IQOS customers become IQOS Plus members upon opening an IQOS account detailed in 1.2.
3.2 IQOS PLUS Gold: Between 28 January to 31 May 2025, all IQOS customers who have completed the Conversion Support journey, or an equivalent, will be awarded IQOS PLUS Gold status.
3.3 Benefits of IQOS PLUS Gold Status:
3.3.1 Access to an exclusive product range.
4. Achieving IQOS PLUS Gold Status (to 1 June 2025 only):
4.1. IQOS PLUS Gold Status is based on direct engagement with iqos.co.nz or IQ Vape Newmarket to consumers. Customers will be notified when they qualify for Gold Status.
5. Downgrading of Gold Status by us:
5.1. Your account will be downgraded to IQOS Plus where:
5.1.1. There is no engagement with iqos.co.nz or IQ Vape Newmarket for 6-month period after being granted Gold Status.
5.1.2. You request your IQOS PLUS Gold Status be downgraded by contacting our Customer Care team.
6. Downgrading of Gold Status by you:
6.1. At any stage you may request your IQOS Plus Gold status be downgraded. Simply call our Customer Care team on 0800 810 433, 9am-6pm Monday to Friday on a working day, to make this request.
7. Electronic Communications
7.1. You acknowledge and agree that we may send you electronic communications including but not limited to communications about our products and latest updates to IQOS Plus.
7.2. You may unsubscribe to our communications at any time by clicking on the ‘unsubscribe’ or ‘Opt Out’ hyperlink in our emails or texts. You can also update your email communication preferences on the ‘My Profile’ page of our website, after signing into your online IQOS account.
8. IQOS Plus Status:
8.1. You agree:
8.1.1. Not to allow any other person to use your IQOS Plus Account;
8.1.2. To keep your IQOS Plus Account safe and secure;
8.1.3. To hold one IQOS Plus Account at any one time;
8.1.4. To promptly notify us if you change your address or contact details; and
8.1.5. To comply with these terms.
9. Privacy Notice
9.1. By applying for your IQOS Plus Account, you authorise Philip Morris to collect, store, use and disclose your personal information in accordance with our Consumer Privacy Notice, available at https://pmiprivacy.com/en/consumer.
10. Warranty/Limitation of Liability
10.1. Philip Morris shall not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your IQOS Plus Account. Philip Morris shall not be liable for any of the losses described in this paragraph 8.1 even if you have informed Philip Morris of the possibility of such losses.
10.2. Nothing in this paragraph excludes any liability that cannot be excluded by applicable law.
11. Miscellaneous
