It's illegal to vape inside any "workplace" i.e. where anyone works or volunteers their time so that takes out supermarkets, cinemas and clubs. Generally speaking, inside any place where someone else works is off limits to vaping. A Specialist Vape Retailer is about the only exception.

Other vaping no-no’s where vaping isn’t allowed:

  • inside any licensed premises
  • and casinos as well as the ‘pokies’ at pubs and bars

What if I go outside to vape?

Many workplaces, retail centres and pubs etc., provide designated vaping areas. Simply ask to find the one closest to you.

How about when I’m walking down the street or seated outside at a cafe?

Be a polite kiwi and be mindful of others when vaping outside, especially in crowded areas and keep an eye out for signage. Some councils have policies that restrict vaping in certain areas but by politely asking, you’ll find where it’s okay to vape. With outside seating at a café just ask the staff. Some may say yes, some may say no and others may have no choice (i.e. due to council policy).

How about hospitals and care homes?

This depends on the individual facility where a room may be provided but this is strictly for patient or resident use only i.e. staff or visitors are not permitted to vape inside.

What about cars or the work van?

It depends on whose vehicle it is and the age of those you may be driving. If it’s a work vehicle then it depends on your employer allowing it. If it’s your own car, then vaping is allowed so long as no one aged 17 or younger is in the car with you (stationary or moving).
